Seit Oktober 2018 verlieren geflüchtete Migrant*innen, die vom Kanton Bern in Asyllagern isoliert werden, ihren Anspruch auf Nothilfe oder Asylsozialhilfe, sobald sie weniger als fünf Nächte pro Woche im Lager oder mehr als zwei Nächte am Stück ausserhalb des Lagers übernachten. Die Behörden sind auch frei, die Personen dann offiziell als untergetaucht zu melden und sie so aus dem Asylverfahren auszuschliessen.
Das Migrant Solidarity Network zusammen mit einer Gruppe Anwält*innen kritisiert diese neue Regel. Sie respektiert die Grundrechte nicht und der Kanton hat sie ohne gesetzliche Grundlage eingeführt. Wir haben den Behörden unsere Kritik geschickt. Wir wollen uns auch juristisch gegen diese neue Regel der Freiheitsbeschränkung wehren und gemeinsam eine Beschwerde einreichen.

Wichtige Fragen und Antworten für Menschen, die die Beschwerde mitunterzeichnen wollen:
- Darf ich die Beschwerde unterschreiben? Personen, die im Kanton Bern in einem Asylcamp leben müssen oder bis vor kurzem in einem Asylcamp leben mussten.
- Wo kann ich die Beschwerde unterschreiben? Die Beschwerde kann am Donnerstag 24. oder 31. Januar zwischen 13 und 18 Uhr in die Brasserie Lorraine (1. Stock) Quartiergasse 17 in Bern unterschrieben werden. Es sind Anwält*innen dort, die alles genau erklären.
- Was muss ich mitnehmen? Personen mit Ausweis N, F, oder B müssen den Ausweis und wenn möglich eine Bestätigung der Asylsozialhilfe mitbringen. Personen mit einem Negativentscheid müssen das Papier Blanc (weisse Papier) und wenn möglich eine Bestätigung der Nothilfe mitbringen.
- Was kostet es? Nichts! Die Kosten für das Verfahren werden bezahlt.
- Hat die Beschwerde einen Einfluss auf mein Asylgesuch? An sich nicht. Die Beschwerde richtet sich gegen den Kanton. Der Kanton ist für die Asylcamps verantwortlich. Für das Asylgesuch ist das Staatssekretariat für Migration (SEM) und nicht der Kanton zuständig. Es sind zwei sehr unterschiedliche Verfahren.

Depuis octobre 2018, les personnes isolées dans des camps d’asile par le canton de Berne perdent leur droit à l’aide d’urgence ou à l’aide sociale si elles passent moins de cinq nuits par semaine dans le camp ou plus de deux nuits consécutives en dehors du camp. Depuis lors, les autorités sont libres de déclarer officiellement ces personnes comme disparues et de les exclure de la procédure d’asile.
Le Migrant Solidarity Network et des avocat.e.s critiquent cette nouvelle règle. Elle ne respecte pas les droits fondamentaux et le canton les a introduits sans aucune base légale. Nous avons envoyé nos critiques aux autorités. Nous voulons également nous défendre juridiquement contre cette nouvelle règle de restriction de la liberté et déposer conjointement une plainte.

- Qui peut signer la plainte ? Les personnes qui doivent vivre dans un camp d’asile dans le canton de Berne ou qui vivaient jusqu’à récemment dans un camp d’asile.
- Où puis-je signer la plainte ? La plainte peut être signée le jeudi 24 ou le 31 janvier entre 13h00 et 18h00 à la Brasserie Lorraine (1er étage) Quartiergasse 17 à Berne. Il y a des avocats qui expliquent tout en détail.
- Qu’est-ce que je dois emporter avec moi ? Les personnes ayant un permis N, F ou B doivent présenter leur pièce d’identité et, si possible, une confirmation de l’aide sociale en matière d’asile. Les personnes ayant une décision négative doivent apporter le « papier Blanc » et, si possible, une confirmation de l’aide d’urgence.
- Combien ça coûte ? Rien. Les frais de procédure seront pris en charge.
- La plainte a-t-elle une influence sur ma demande d’asile ? Pas en soi. La plainte est dirigée contre le canton. Le canton est responsable des camps d’asile. Le Secrétariat d’Etat de migration (SEM) est responsable de la demande d’asile et pas le canton. Ce sont deux procédures très différentes.

If you have to live in an asylum camp in the canton of Berne, then read on.
Since October 2018, refugees who are isolated in asylum camps by the canton of Berne lose their right to emergency aid or asylum social aid if they stay less than five nights a week in the camp or more than two nights in a row outside the camp. Since then, the authorities are free to declare the persons officially disappeared and to exclude them from the asylum procedure.
The Migrant Solidarity Network together with left lawyers criticises this new rule. The new rule does not respect fundamental rights and the canton has introduced it without any legal basis. We have sent our criticism to the authorities. We also want to defend ourselves legally against this new rule of the restriction of freedom and jointly submit a complaint.

- Who may sign the complaint? Persons who have to live in an asylum camp in the canton of Berne or who until recently had to live in an asylum camp.
- Where can I sign the complaint? The complaint can be signed on Thursday 24 or 31 January between 1 p.m. and 6 p.m. at Brasserie Lorraine (1st floor) Quartiergasse 17 in Bern. There are lawyers who explain everything in detail.
- What do I have to take with me? Persons with permit N, F or B must bring their permit and, if possible, a confirmation of asylum social aid. Persons with a negative decision must bring „white paper“ and, if possible, confirmation of emergency aid.
- What does it cost? Nothing! The costs for the proceedings are paid.
- Does the complaint have any influence on my asylum appeal? Not in itself. The complaint is directed against the canton. The canton is responsible for the asylum camps. The State Secretariat for Migration (SEM) is responsible for the asylum appeal and not the canton. These are two very different procedures.
